1About this policy

DigiStay Pty Ltd (ABN 30 679 162 200) (DigiStay, we, us or our) provides property management system, onboarding, revenue management, channel management and guest experience services to accommodation businesses.

This Privacy Policy explains how we collect, use, store and disclose personal information through our website at www.digistay.com.au (Website), when you contact us, and when we provide our services to you. We handle personal information in accordance with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs).

By using our Website, enquiring about our services or becoming a client, you acknowledge that your personal information will be handled as described in this policy.

2Key terms

(a)Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not the information is true and whether or not it is recorded in a material form.

(b)Sensitive information includes information about an individual's health, racial or ethnic origin, political opinions, religious beliefs, sexual orientation, criminal record or membership of a trade union or professional association. We do not intentionally collect sensitive information. If we ever need to, we will only do so with your consent or where required or authorised by law.

3What we collect

The personal information we collect depends on how you deal with us.

Enquiries and the revenue calculator

When you contact us, book a call or use the revenue calculator on our Website, we may collect your name, property or business name, email address, phone number and the details you enter into the calculator (such as number of rooms, average nightly rate, occupancy and the results it produces).

Clients

When you become a client, we may also collect:

  • contact details of owners, managers and staff we work with;
  • business details such as ABN, business and billing address;
  • billing and payment information (card payments are processed by our payment provider, and we do not store full card numbers);
  • property and performance information, such as rates, occupancy, bookings, revenue and channel data, which may include information about individuals;
  • login or access details you provide so we can work in your property management system, channel manager, booking engine or online travel agency (OTA) accounts; and
  • records of our communications with you, including emails, calls and meeting notes.

Website visitors

When you visit our Website, our hosting provider and the third-party services used on the Website may automatically collect technical information such as your IP address, browser type, device information and the pages you view. Cookies may be used to help the Website work properly. Our Website does not use advertising cookies.

4Information about your guests

To deliver our services, we may access or process information about your guests that is held in your property management system, channel manager, booking engine or OTA accounts, such as guest names, contact details, booking details and stay history.

When we do this, we act on your behalf and on your instructions. We access guest information only to provide the services you have engaged us for, we do not use it for our own marketing, and we do not sell it. As the accommodation provider, you remain responsible for having an appropriate privacy policy and for telling your guests how their information is handled.

5How we collect personal information

(a)We collect most personal information directly from you, for example when you complete a form on our Website, book a call, email or call us, or sign up for our services.

(b)We may collect information from third parties where it is reasonable to do so, for example from your property management system or channel partners when you authorise us to access them, from our technology partners when they refer you to us, or from publicly available sources such as your property's online listings.

(c)If we receive personal information we did not ask for, we will decide whether we could have collected it lawfully. If not, we will destroy or de-identify it where it is lawful and reasonable to do so.

6Why we collect and use personal information

We collect, hold and use personal information to:

  • respond to your enquiries and show you your revenue calculator results;
  • follow up with you about your results and how we may be able to help your property;
  • schedule and hold discovery calls and meetings;
  • provide, set up, manage and support our services, including our property management system, onboarding, revenue management, channel management and guest experience services;
  • prepare performance reports and recommendations;
  • invoice you and process payments;
  • improve our Website and services;
  • send you updates about our services, where permitted (see section 9); and
  • comply with our legal obligations and resolve disputes.

If you do not provide the information we ask for, we may not be able to respond to your enquiry or provide our services.

7Who we share personal information with

We do not sell personal information. We may disclose personal information to:

  • our team members and contractors who need it to deliver our services;
  • service providers who help us run our business, such as website hosting, online form and email services, appointment scheduling, payment processing, cloud storage and business software providers;
  • technology partners such as property management systems, channel managers, booking engines, OTAs and revenue management tools, where needed to deliver the services you have engaged us for;
  • our professional advisers, such as accountants, lawyers and insurers; and
  • government authorities or other parties where required or authorised by law.

We require our service providers to handle personal information only for the purpose for which we provide it and to protect it appropriately.

8Overseas disclosure

Some of our service providers, technology partners and team members are located outside Australia, or store data on servers outside Australia, including in the United States and other countries where those providers operate. Because these arrangements change over time, it is not practicable to list every country. Before disclosing personal information overseas, we take reasonable steps to ensure the recipient handles it in a way that is consistent with the APPs.

9Marketing communications

With your consent, or where the law otherwise permits, we may send you updates, insights and information about our services. Every marketing email includes a simple way to unsubscribe, and you can also ask us at any time to stop sending you marketing. We do not use sensitive information for marketing.

10Storage and security

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. These steps include restricting access to the people who need it, using reputable providers with strong security practices, and keeping system login details confidential and limited to the team members working on your account.

No method of transmitting or storing information is completely secure. If a data breach occurs that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme.

11How long we keep information

We keep personal information only for as long as we need it for the purposes set out in this policy or as required by law. Client records are generally kept for up to 7 years to meet our record keeping obligations. Enquiry and calculator information is kept while it remains relevant to our relationship with you. When information is no longer needed, we take reasonable steps to destroy or de-identify it.

12Accessing and correcting your information

You may ask for access to the personal information we hold about you, or ask us to correct it if you believe it is inaccurate, out of date, incomplete or misleading. Please contact us using the details below. We will respond within a reasonable time, usually within 30 days. If we refuse your request, we will explain why, unless it would be unreasonable to do so.

13Complaints

If you have a concern about how we have handled your personal information, please contact us in writing using the details below. Your complaint will be reviewed by Juvina Lai, and we may ask you for more information to understand your concern. We aim to respond within 30 days.

If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner at www.oaic.gov.au.

14Changes to this policy

We may update this Privacy Policy from time to time to reflect changes to our services, practices or the law. The current version will always be available on our Website, with the date it was last updated.
